Standard Terms of Sale
- Whilst we endeavor to ensure that the information on this site is accurate and complete, we make no warranties about the accuracy, reliability, completeness or timeliness of information published on this website.
- There is no charge to the Bridal Couple for the services we render.
- Guests who choose to order their gifts from a bridal list will be charged a R20 service fee. This service fee will cover wrapping the gifts, writing the card, and delivering the gifts to the couple.
- Whist The Gift Company makes every effort to only list items that are usually in stock, there may be times when a certain item is out of stock and has to be ordered in from overseas, or created especially on request. This may result in gifts not being available for delivery at the arranged time. The Bridal Couple will be notified of the arrival of the wedding gifts and will be required to collect the outstanding wedding gifts from The Gift Company showroom in Harfield Village. The Gift Company does not accept liability for wedding gifts that are not available for initial delivery at the arranged time.
- If The Gift Company receives notice from a supplier that an item is no longer supplied the following will apply:
- if the item has not been purchased, The Gift Company reserves the right to remove it from those Gift Lists on which it features, without notifying the bridal couple.
- if the item has been purchased by a guest, an equivalent product will be made available or the bridal couple will be offered a gift voucher to the value of the discontinued item valid for a period of six (6) months from the date of the wedding.
- If an electrical appliance is not available for delivery at the arranged time, the Bridal Couple will be entitled to one of the following:
- The same electrical appliance at a similar price in a different brand
- A gift voucher to the value of the electrical appliance valid for a period of six (6) months from the date of the wedding
- To be notified to collect the electrical appliance from the Gift Company showroom once it arrives
- For a period of three months after the date of the wedding, the Bridal Couple will be entitled to a 10% discount on items, excluding appliances, on their gift list that they did not receive as a wedding gift.
- The Gift Company will order the items from our suppliers as soon as the orders/payments come in from the guests.
- After the wedding the list can be closed at an agreed point. At this point the couple decides on what they wish to spend their The Gift Company Gift Voucher gifts. Gift vouchers given to the Bridal Couple are valid for a period of 6 (six) months after the date of the wedding. Any The Gift Company gift vouchers spent at this stage DO NOT attract the 10% discount.
- Gifts and gift vouchers cannot be exchanged for cash.
- The Gift Company takes no responsibility if a gift purchased through The Gift Company duplicated by purchase of the same gift via another source or gift registry service. By this token we strongly discourage couples from putting the same products on different gift lists.
Delivery policy
- Subject to availability and receipt of payment, requests will be processed within 2 days and delivery confirmed by way of email.
- Once off gift purchases are subject to individual delivery charges to be negotiated directly with The Gift Company.
- If purchase is off a bridal gift list, the gifts will be delivered in one batch directly to the bridal couple at their convenience.
- We offer the service of co-coordinating the courier/shipment of gifts to couples that do not live in Cape Town, particularly for Bridal Couples that live abroad. The couple is responsible for the cost of this service which must be paid prior to any items being sent.
- The Gift Company will supply all goods to the bridal couple or delivery company in good order. The Gift Company will not be held liable for the condition of goods arriving at the User's chosen delivery address.
- We do not accept liability for damage to wedding gifts delivered by guests to the Bridal Couple.
Return and Refunds policy
- Products may not be returned unless The Gift Company has supplied the incorrect product or the product is damaged or faulty on delivery.
- Guarantees and warranties of appliances are as per the individual manufacturers standards.
- Cancelled orders on the e-commerce facility will be refunded after deduction of a 10% charge for administration costs.
- The Gift Company makes no representations or warranties regarding any products.
Customer privacy policy
- The private information required for executing the orders placed through the e-commerce facility, namely personal information, address details and telephone numbers will be kept in the strictest confidence by The Gift Company and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.
- The Gift Company undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Gift Company cannot be held responsible for security breaches occurring on the User's electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.
- The Gift Company shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment may be made via Visa, MasterCard credit cards or by bank transfer into the The Gift Company bank account:Standard Bank

Credit card acquiring and security
Credit card transactions will be acquired for The Gift Company via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by The Gift Company separately from card details which are entered by the client on PayGate's secure site. For more detail on PayGate refer to www.paygate.co.za.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
The Gift Company takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Country of domicile
This website is governed by the laws of South Africa and The Gift Company chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature. 52 First Avenue, Harfield Village, Claremont, 7708, Cape Town
Variation
The Gift Company may, in its sole discretion, change this agreement or any part thereof at any time without notice.
